About this policy
This Acceptable Use Policy sets out the standards that apply when you use the That Makeup Brand website, our accounts on social platforms, our customer service channels and any content or feature we make available (the "Services"). It forms part of our Terms and Conditions. By using the Services you agree to follow it.
1. Prohibited uses
You must not use the Services:
- in any way that breaches any applicable law or regulation, or that is fraudulent, deceptive or harmful;
- to purchase products for resale, distribution or commercial use without a written wholesale agreement with us;
- to place orders using false identities, stolen payment details or multiple accounts to circumvent quantity or promotion limits;
- to exploit, share or stack discount codes, referral rewards or promotions in a way that is contrary to their terms or clearly unintended;
- to make false claims about orders, deliveries or product faults in order to obtain refunds, replacements or credits;
- to harass, abuse, threaten, defame or discriminate against any member of our team, our partners or other customers;
- to post or send content that is unlawful, obscene, hateful, sexually explicit, violent, defamatory, infringing or otherwise objectionable;
- to send unsolicited advertising or promotional material, or to use our channels to promote other businesses without permission;
- to impersonate That Makeup Brand, our staff, an ambassador or any other person, or to misrepresent your affiliation with us.
2. Technical misuse
You must not:
- use bots, scrapers, crawlers or other automated tools to access the Services, extract data, monitor prices or stock, or place orders, without our written permission (standard search-engine indexing excepted);
- attempt to gain unauthorised access to any part of the Services, our systems, other customers' accounts or data;
- probe, scan or test the vulnerability of the Services or breach any security or authentication measure;
- introduce viruses, malware or any other harmful code, or interfere with the proper working of the Services;
- overload, flood or attack the Services, or take any action that imposes an unreasonable load on our infrastructure;
- reverse engineer, decompile or copy any part of the Services, or remove any copyright or proprietary notice;
- frame, mirror or deep-link to the Services in a way that misrepresents their source or ownership.
If you discover a security vulnerability, please tell us responsibly at legal@thatmakeupbrand.com rather than exploiting or publicising it.
3. Content and intellectual property
Our photography, product names, copy, formulas, packaging and designs are protected. You may share links to our pages and may share our public social posts using the platform's own sharing features. You may not copy our product photography or copy for use on another website, marketplace listing or social account, use our name or logos to suggest an endorsement we have not given, or sell counterfeit, decanted or repackaged versions of our products.
4. Content you contribute
Reviews, comments, photos, messages and any other content you share with us must be your own, accurate, respectful and free of personal information about other people. They must not contain medical claims, promotional content, spam or anything prohibited by this policy. Our Brand Ambassador, Influencer & Review Policy sets out further standards for reviews and promotional content, and our Terms and Conditions explain the licence you grant us over content you share.
5. Respect for our team
Our customer care team will always treat you with courtesy and expects the same in return. We may end a conversation, decline to continue providing support, cancel orders or close an account where a customer is abusive, threatening or persistently unreasonable. This does not affect your rights under the Australian Consumer Law, which we will continue to honour through written channels.
6. Monitoring and enforcement
We may monitor use of the Services to detect breaches of this policy, although we are not obliged to. If we reasonably believe that you have breached it, we may, without notice: remove content; cancel orders; suspend or close your account; refuse future orders; withhold commissions or rewards; report conduct to platforms, payment providers or law enforcement; and take legal action to recover any loss we suffer. We may also block access from IP addresses or devices associated with abuse.
7. Reporting
If you see content or behaviour on our Services that breaches this policy, or believe your intellectual property has been infringed, contact legal@thatmakeupbrand.com with details, including links and, for infringement claims, evidence of your ownership. We will review every report.
8. Changes
We may update this policy at any time by posting the revised version here. Continued use of the Services after a change means you accept it.
